Estate Administration & Probate

Estate Administration - when someone dies, its the process of taking care of the necessary legal and financial admin. and distribution of their 'estate' (all they legally own)

If a Will exists-

Executors need to retrieve the original will and are legally responsible and accountable for all the Estate Admin., including initially accounting for all the estate's assets, paying taxes, applying for probate, dealing with all the legal and financial matters and finally distributing the estate according to the Will's instructions. The process can be complicated, onerous, and is unpaid.

Only Executors can delegate this responsibility to others (see below)

No Will-

Persons (e.g family members) can apply to be a Legal Personal Representatives (LPR's). They will then be legally responsible and accountable for all the Estate Admin. this includes initially accounting for all the estate's assets, paying taxes, applying for probate, dealing with all the legal and financial matters and finally distributing the estate according to the Laws of Intestacy. The process can be complicated, onerous, and is unpaid.
